Article 1 (Objective)
These Terms of Use set forth the terms and conditions for using the travel plan proposal and introduction/proxy booking service (hereinafter referred to as “Service”) for experience-based and other events (hereinafter referred to as “Program”) offered by [ENGAWA Co., Ltd.] (hereinafter referred to as “Company”) that operates [TADAIMA TOURS].
Article 2 (Scope of use)
- These Terms of Use shall apply to all relationships between the user of the Service (hereinafter referred to as “User”) and the Company in relation to the Service.
- Part of these Terms of Use shall apply to the User of the Service as well as the stores and event sponsors that offer the Program (hereinafter referred to as “Operator”).
Article 3 (Details of the service)
- The Service shall provide the following services to the User.
(1) Propose travel plans
(2) Introduce experience-based events
(3) Book experience-based events on behalf of the User
(4) Services ancillary to the above - The User may confirm the details, fees, and availability of the events of the Service on their own based on the information provided by the Company.
Article 4 (Non-application of the Travel Agency Act)
The Service shall not correspond to a travel business or travel agent business under the Travel Agency Act. The Company only provides information and performs proxy booking for the User rather than arranging, planning, and implementing travel, and the Company shall not be responsible for any travel operations.
Article 5 (Conclusion of an agreement)
- The User may, by consenting to these Terms of Use, use the Service in accordance with the method designated by the Company.
- The use agreement between the Company and the User shall be concluded at the point in time when the Company transmits to the User the notice of booking completion, and at the same time, the use agreement between the User and the Operator shall be deemed concluded.
Article 6 (Fees and payment method)
- The User shall pay the fees or deposit required for using the Service by the method designated by the Company.
- The payment for proxy booking shall be settled in advance, in principle, and the payment method designated by the Company shall be used.
- When advance payment via the Company is not applicable, or when the payment needs to be made directly to the Operator, the Company shall notify the User of the payment method and points to note when the booking is completed.
Article 7 (Cancellation/ changes)
- When the User cancels or changes the proxy booking, the User shall comply with the Cancellation Policy separately stipulated by the Company and the Operator.
- The Company or the Operator may cancel or change the event because of weather conditions or the Operator’s circumstances. In that case, the Company shall notify the User as promptly as possible.
Article 8 (Prohibited matters)
The User may not engage in any of the following acts when using the Service.
- Act of providing false information
- Act of causing a disadvantage to another User or a third party
- Act of hindering the operation of the Service or operations of the Operator
- Act of violating the laws and regulations or public order and morality
- Act of impersonating another person or creating a false account
- Act of using the Service for the purpose of making profits or act of solicitation or advertisement without permission
- Act of making unauthorized access to the Service system or act of using an unauthorized program
- Act of infringing the intellectual property rights, privacy rights, reputation, or other rights of the Company or a third party
- Act that impairs the operation of the Service, such as making excessive cancellations or complaints
- Other acts that are deemed inappropriate by the Company
Article 9 (Exemptions)
- The Company is not the provider of the Program and does not guarantee the completeness, accuracy, and safety of the details of the Program offered by the Operator.
- The Company shall not be responsible for any problems or damage occurring as a result of participating in the Program through the Service unless such is caused by the intention or gross negligence of the Company.
- The Company shall not assume any responsibility when the provision of the Service or Program becomes difficult because of a natural disaster, communication failure, system malfunction or hindrance by a third party.
- The Company shall not be involved in and responsible for any trouble occurring between the User and the Operator or between the User and a third party.
- The Company shall not be responsible for any direct or indirect damage caused as a result of using the Service.
Article 10 (Handling of personal information)
The Company shall appropriately handle the User’s personal information in accordance with the Privacy Policy (https://www.tokyoweekender.com/privacy-policy/) and the Personal Information Protection Act of Japan.
Article 11 (Revision to the Terms of Use)
The Company may revise these Terms of Use when it deems necessary. The revised Terms of Use shall be announced through the Service, and the User shall be deemed to have consented to the revision at the point in time when the User uses the Service after the notification of the revision is given.
Article 12 (Governing law and jurisdiction)
These Terms of Use shall be construed and applied in accordance with the laws of Japan. For any disputes arising in relation to the Service, the Tokyo District Court shall be the exclusive court of competent jurisdiction for the first hearing.
